The procedure was approved by the Customs Service in accordance with Article 68 of the Customs Code and applies in cases of reasonable doubt as to the authenticity of documents of origin or preferential origin of goods. The new provision aims to prevent fraud and strengthen commercial discipline, while providing a fair and predictable mechanism for economic operators.
The CU RM assures that the innovation will provide the following advantages for the participants of foreign economic activity: goods will not be blocked – they will be released on the same day, even in case of doubt, based on the provision of a guarantee; import duties will not be paid in advance, and the guarantee will be returned in full upon confirmation of the declared origin; bona fide importers will be protected from unfair practices; transparency and efficiency will be ensured, as the procedure is integrated into the IT system ASYCUDA World, which will reduce the risk of fraudulent practices.
“Our goal is to help companies continue to operate smoothly while ensuring that tariff benefits are applied correctly. This is an important step for safer and fairer trade,” justified the innovation by Alexandru Jakub, Director of the Customs Service.
The procedure is carried out in five steps.
Notification and right of reply – the economic operator is notified and can submit additional information and documents.
Provision of a guarantee – if suspicions persist, preferential tariff treatment is suspended and the importer provides a guarantee for payment of duties.
Release of goods – the goods are provided to the declarant on the same day together with a guarantee of the right to import.
International verification – proof of origin is verified jointly with the authorities of the exporting country.
Final decision – if the origin of the goods is confirmed, the guarantee is refunded in full; otherwise, the amount due is deducted from the guarantee.
