
The law will reduce the burden on the judicial system and shorten the timeframe for concluding mediation agreements between parties in out-of-court proceedings. Incentives for the use of paid mediation are also envisaged in the form of benefits for the parties. A separate article of the legislative act regulates these measures, including installment payment of state duty and conditions for its refund in a certain ratio in case of dispute resolution.
As previously reported by logos-press.md, the draft Law on Mediation and the Status of Mediator was criticized by experts in the sense that in international practice paid mediation is not mandatory for the protection of citizens. Nevertheless, it was adopted by the Parliament at the last meeting of the 2025 winter session.
The law applies to civil disputes worth up to 50 average salaries in the economy, as well as family disputes related to parental rights, other disputes between spouses, former spouses or family members. The exceptions are family violence and divorce cases. Labor disputes are exempted from the fee for the first mediator’s session, which will cost 10% of the minimum wage.
The Law on Mediation and the Status of Mediator was published on March 12 this year and will be implemented in 6 months, on September 12, 2026. The previous Mediation Law of 2015 will be declared null and void.
