Government launches foreclosure proceedings in the case of Ukrainian company Stileks

The Moldovan government plans to conclude a legal assistance contract to represent the state in Ukraine. The matter concerns the procedure of recognition and enforcement of the judgment of the Paris Court of Appeal (CA Paris) of January 10, 2023.

According to the draft decree, the Justice Ministry will sign a contract with the Ukrainian law firm Law Offices of Martinenko, Volkovetskyi & Partners in partnership with the Moldovan law firm Zamfir și Partenerii. The cost of the services will amount to 15 thousand euros. These companies were selected following a tender in December 2025.

The aim is to recover 250 thousand euros from the company SPC Stileks, the successor of the Ukrainian companies Komstroy and Energoalliance. This amount was awarded in favor of the Republic of Moldova as court and other expenses.

The dispute between the Republic of Moldova and the Ukrainian company Energoalliance (later Komstroy, then SPC Stileks) arose over electricity supplies in the late 1990s, for which the company demanded multimillion-dollar compensation and even won an arbitration in 2013.

The claims were for about $50 million, but as a result of the 2013 arbitration award, Moldova actually tried to recover the equivalent of about 593 million lei plus about $540 thousand.

In January 2023, the Paris Court of Appeal (CA Paris) overturned the 2013 arbitral award. At the same time, the court ordered SPC Stileks to compensate Moldova for its legal expenses and to pay additional amounts.

The judgment became enforceable as it was not appealed before the French Court of Cassation. However, the actual recovery of funds requires recognition and enforcement of the judgment in Ukraine, where the debtor is located.

The legal costs will be covered from the budget of the Ministry of Justice for 2026.

The relevant draft decree is scheduled to be discussed at a government meeting on Wednesday, April 1.
