
The Bill aims to prevent and effectively combat unlawful acts in the field of electronic communication networks and services. It should be noted that an unlawful device is an equipment or program designed or adapted to provide access to a protected service without the authorization of the provider of that service.
This includes, for example, devices that allow access to pay-TV, online streaming or video and audio subscriptions without the authorization of the rights holders.
These include pay-TV services, streaming platforms such as Netflix or online movie theaters.
Thus, the production, import, distribution, sale, lease or storage for commercial purposes of illegal devices will be fined up to MDL 4,500 for individuals and up to MDL 6,000 for persons in positions of responsibility. The fine for legal entities violating this provision will be up to 15,000 lei, with deprivation of the right to carry out certain activities for a period of six months to one year.
At the same time, the fine for installing, maintaining or replacing for commercial purposes an illegal device will be up to 1,500 lei for individuals, up to 9,000 lei for persons holding responsible positions and up to 12,000 lei for legal entities.
Sanctions are also envisaged for using commercial communication to promote illegal devices. The legislative amendments will enter into force on March 13, 2027.
