Such innovations in the regulatory framework are contained in the amendments to the current legislation proposed by the government. The document also provides for the abolition of provisions according to which persons registered in the State Register of Legal Entities, in the Unified Case Management System or in the information systems of the State Tax Service as founders, co-founders or administrators of commercial legal entities were deprived of the right to be registered as unemployed.
Currently, EU citizens and their family members are considered as foreign citizens on the territory of Moldova and cannot be registered in the ANOFM without a residence permit. Therefore, many of them, having only a visa, cannot be registered as unemployed and benefit from ANOFM services and measures.
Under the new legal framework, EU citizens and their family members have access to the labor market by being designated as a separate category of citizens who will benefit from ANOFM services. Starting from the first quarter of 2026, regulations must be amended so that ANOFM can register them in the status of unemployed jobseekers. The project foresees the actualization of this decision.
Currently there are about 300 EU citizens with residence permits in Moldova who could request ANOFM services.
In addition, persons carrying out independent activity, according to Chapters 10.2, 10.3 and 10.4 of Title II of the Tax Code, will not be able to register as unemployed. This measure is introduced in the secondary legal framework on the approval of the access to employment measures to strengthen it.
Verification of the occupational status of these persons will be carried out by the National Employment Agency (ANOFM) by reviewing account statements through interconnections with the National Social Insurance Fund (CNAS).
