
This is one of the innovations to eliminate “over-regulation” of business contained in Law No. 229/2025, published on July 23, amending certain regulations. It contains amendments to 14 laws, including No. 845/1992 on Entrepreneurship and Enterprises.
These amendments remove the prohibition on the establishment of new enterprises by a person who is the founder of a company that is not operating, not liquidated and has debts to the budget.
The authors of the amendments believe that this provision is a barrier limiting the freedom of entrepreneurial activity and discouraging economic initiative, while the opening of a new business represents a potential source of payments to repay the debts of the enterprise.
