
The project was developed in the context of Moldova’s intention to join the Convention on the Granting of European Patents, adopted in Munich in 1973.
The new provisions also aim at harmonizing national legislation with the provisions of the relevant EU acts in this field and introducing modern mechanisms for the protection of inventions, including additional protection certificates and compulsory licenses for pharmaceutical products intended for export to countries affected by public health problems.
The adoption of the amendments will make it possible to extend the validity of the European patent on the territory of Moldova, facilitating the access of inventors to the European patent system and related benefits. At the same time, it will strengthen the protection of intellectual property rights, reduce infringement and increase legal certainty for patent holders.
The Bill also aims to optimize the procedures for examining patent applications, correct inconsistencies arising from the application of existing legislation and bring the national protection system in line with modern requirements in this field.
The amendments are aimed at stimulating interest in research and development, especially in the pharmaceutical and phytosanitary sectors, thus contributing to the country’s economic progress based on innovation and competitiveness.
