The regulatory framework is being adjusted to the Urban Planning Code

The Ministry of Infrastructure and Regional Development continues to develop documents aimed at harmonizing the regulatory framework with the provisions of the Urban Development Code. The Cabinet of Ministers approved two drafts at a meeting on 8 October, Logos Press reported.

The first draft provides for amendments to the Government Decision “On a single window for issuing permits for construction works”. The aim is to harmonize the procedure for issuing permits in the construction sector; to extend the deadline for the integration of local governments into the Automated Information System for the Management and Issuance of Permits (SIA GEAP) until January 1, 2027; to simplify and increase the transparency of the process of issuing permits for construction works.

The second project is aimed at adjusting the Government Regulation “On Control of Operational Behavior, Interventions over Time and After Use of Structures”.

The amendments propose the harmonization of terminology with the requirements of the Urban Planning and Construction Code, in particular, the updating of the names of a number of government agencies that have changed their names.

When demolishing a construction object, it is often difficult to find the author of the original project. “In case of impossibility to engage the designer of the construction object, the project of demolition of the construction object shall be developed by another designer on the basis of the conclusion of technical expertise in accordance with the provisions of the Code”, – the document says.

Requirements for the dismantling of buildings, waste management and application of environmental protection measures are established. Thus, performance of works on demolition of a construction object is allowed to be carried out by individuals or legal entities authorized to perform construction works, as specified in the Code.

Standardization of roles and responsibilities of certified professionals in accordance with European practice is envisaged.
