Tax authorities will report VAT discrepancies

Starting November 1 this year, the State Tax Service (STS) launched an online mechanism for notifying taxpayers of discrepancies detected by the information system in VAT declarations. The procedure became possible due to the launch of a new module “VAT Risk Management” operating within the automated information system “Compliance Risk Management”.

Upon receiving the notification, the taxpayer must analyze the value added tax declaration submitted by him and, if erroneous information is found in it, notify the territorial subdivision of the State Tax Service at the place of service.

The new digital tool will help STS specialists manage the risks of discrepancies in VAT amounts, which are most often encountered in tax practice. These include cases of unjustified overstatement of VAT intended for transfer to the account, cases of suppliers failing to submit tax invoices in Annex No. 2 to the VAT return, as well as cases where suppliers or buyers have discovered discrepancies in the value or amount of VAT related to the purchase recorded by the beneficiary in Annex No. 1 to this return.

If at least one of these risks is detected, the taxpayer will be sent a notice of possible errors with a proposal to correct the information in the document. They will be sent immediately after the deadline for submitting a VAT declaration. In the event of failure to comply with this requirement, the taxpayer will be notified again by the 15th day of the following month with an explanation of possible sanctions applicable under the provisions of the Tax Code.
