
This provision is contained in the new Law on Public Procurement. It was approved by the Parliament in final reading at the session of December 29, 2025.
The document transposes European directives on public procurement into national legislation. The new provisions will ensure greater transparency, efficiency and fairness in the use of public funds, the authors say.
Among the most important innovations is the establishment of differentiated thresholds for the selection of contracts. Thus, in the case of works and social services, the threshold value will amount to one million lei, while in the case of goods and services – 600,000 lei.
The document also contains provisions aimed at reducing administrative barriers and eliminating disproportionate requirements that hinder the equal access of economic operators to public procurement processes. In addition, strict measures have been introduced for the publication of information on public procurements, ensuring transparent and easy access to all opportunities for companies to participate in them, as well as to the results of the procurements.
For the second reading, the legislative initiative was supplemented with an article that stipulates that the evaluation factors, specific scoring methodology, categories of goods, services or works that contribute to achieving the objectives of balanced regional development, as well as integration into the short supply chain and promotion of SMEs, will be approved by a government decree. For this purpose, criteria such as “best quality to price ratio” or “best quality to cost ratio” will be applied.
