The Chisinau City Hall has developed a new document on the rules of auctioning and placement of street trading facilities. Its purpose is to prevent anti-competitive practices, as well as to ensure efficient management and utilization of land owned by the municipality.
According to the order, a 10-member auction commission will be established in the municipality. It will include five representatives each from the Chisinau Municipal Council and the executive branch (Chisinau Mayor’s Office), as well as other subdivisions of the local administration.
The commission examines the location of the exhibited lots and selects them, establishes the requirements and technical criteria for the objects submitted to the auction, examines and establishes the initial price of the exhibited lot, the advance payment and the method of payment of the winner’s price. It is also responsible for monitoring the auction, observing the conditions of participation and the rights of participants, as well as resolving disagreements arising in the process of the auction.
The Commission also deals with the approval of the auction results, withdrawal of lots, suspension or cancellation of the procedure, as well as with the on-site inspection of street vending objects for compliance with the terms and conditions of the Contract on obtaining the right to place street vending objects on the territory of Chisinau, concluded with the City Hall.
To participate in the auction, an application shall be submitted, accompanied by an up-to-date tax certificate confirming the absence of debts to the local budget, an extract from the State Register of Legal Entities, proof of payment of the auction participation fee and advance payment or deposit of a bank guarantee for each auctioned lot.
