
To do so, they will have to pay a higher fixed annual rate of state social insurance contributions to the National Social Insurance Fund. The Government continues to develop the regulatory framework for the new entrepreneurial regime – the so-called “independent activity”.
The procedure involves the submission of a written application in this regard to the State Tax Service once a year, by January 25 or within 20 days from the date of registration of such activity. The application shall be completed in the manner and form prescribed by the National Social Insurance Fund.
The draft law on the amendment of some regulatory acts will be considered at a cabinet meeting in the near future. It includes relevant amendments to Law No. 489/1999 on the State Social Insurance System.
As explained in the information note, the draft law aims at transposing into the Moldovan legislation the EU Directive, which provides for the possibility to provide the persons carrying out independent activity with all social insurance benefits, including maternity benefits, at will.
Individual entrepreneurs who have obtained the right to carry out activities in accordance with the procedure established by law, regardless of the organizational and legal form, including founders of peasant (farmer) farms, individuals carrying out individual entrepreneurial activities in the field of retail trade, except for trade in goods subject to excise tax, as well as individuals carrying out activities in the field of procurement of products, will be able to use all social insurance payments under this scheme if they wish. They also submit an application to the STS by January 25 or within 20 days from the date of registration of their activity. Holders of an entrepreneurial patent submit it at the first request for issuance and/or extension of the patent.
The option of applying a fixed annual social insurance rate, which entitles to all types of social benefits, is mandatory during the year and is not subject to change.
It is planned that the new provisions will enter into force on January 1, 2027.
