Freelancers’ personal data will be protected

Independent entrepreneurs will be assigned a unique fiscal code which will be reflected on cash receipts issued by them. It will be different from the taxpayer's personal code (IDNP).

The amendments to the Law on Personal Data Protection and to the Tax Code provide for the maintenance of an alternative to IDNP. At the last session, parliament adopted them in the first reading. The initiative was developed by a group of MPs from the Party of Communists.

The code will be used in all documentation of such persons, including in the formation of fiscal checks. Today, the IDNP is printed on it, which violates the taxpayer’s right to privacy.

As reported logos-press.md, this problem was pointed out earlier by former patent holders. For them, compulsory fiscalization led to the disclosure of such data as IDNP, first and last name, and address in the receipts.

In this context, the risks were also identified by the National Center for Personal Data Protection, which found that the publication of the state identification number of a natural person (IDNP) in cash receipts and tax documents is a form of excessive and unjustified disclosure of personal data.

A unique fiscal code other than IDNP will be assigned by the State Tax Service at the request of an individual registered as an independent entrepreneur. It will be indicated in cash receipts and tax documents instead of IDNP and other data of the holder.

The State Tax Service will ensure that the code is linked to the Electronic Sales Monitoring information system.
