
These are the new provisions of the Law No. 3111 of 18.12.2025, which came into force on December 31, 2025, concerning the updating of the regulatory and legal framework applicable to the State Labor Inspectorate. The purpose of the new law is to create an improved mechanism of state control in the field of labor relations, occupational safety and health. It is intended to strike a balance between the need for supervision and the protection of the rights of those being supervised.
In essence, it is a revision of the legislation, a conceptual modernization of the labor inspection’s mode of operation, the authors of the changes emphasize. According to the new concept, the inspectorate should combine the functions of a supervisor and assistant-consultant to those being inspected.
The law is supplemented with a new article that regulates the rights of the subject to be controlled. He has the right, according to the new provisions, to verify the powers of control and to familiarize himself with the inspector’s ID card, to be informed about his rights and obligations, to challenge the controllers’ actions by presenting evidence and explanations in his favor, to demand that any documents or copies thereof, on which he is entitled to sign and give written explanations, be attached to the inspection report, and that references to certain facts or rights/obligations be included in the inspection report.
In addition, the controlled person has the right to familiarize himself/herself with the protocol and other documents drawn up during the verification, as well as to be present in person or through his/her representative and to have free and authorized access to all information and documents that relate to the verifications carried out or to be carried out in relation to him/her, except for information that would allow the identification of the applicant.
The inspected entity shall have the right to document the actions of inspectors and accompanying persons by means of witnesses and/or other means such as photography, video, audio recording, etc. As well as to present evidence and sign the electronic protocol of the inspection.
Earlier, business representatives criticized the amendments concerning the expansion of controllers’ powers to conduct unannounced inspections and limiting the validity of the list of planned controls.
