
Before handing over their mandates, MPs approved amendments to the procedures related to the inheritance of citizens’ property. The law, which provides for several changes in this regard, was adopted on 11 July in final reading by 61 MPs.
The legislative initiative was developed as a result of studying several petitions received from citizens, its authors said. They testified to the existence of white spots in the Moldovan legislation on inheritance. The new provisions are meant to eliminate the missing components of the procedure. In general, they are aimed at protecting the rights of heirs and ensuring a more efficient and predictable application of legal norms.
Thus, the authors of the amendments included the spouse who survives the other spouse in the first line of legal heirs. Thus, he will be able to receive, in addition to his inheritance share, also furniture and household items from the common housing of the spouses, to the extent that he needs them to run the household.
Another provision concerns the possibility for any interested person to apply to the court for disinheritance. However, the circumstances constituting the grounds for this must be established by the court. If the court decision is issued after the inheritance has been received, the person deprived of this right is obliged to return what he has received and his inheritance share will be divided equally among the other heirs.
In addition, the new provisions simplify the rules for accepting or renouncing an inheritance, and the time limit for doing so has been extended to 12 months.
The new provisions of the inheritance legislation will enter into force on January 1, 2026.
